These
terms and conditions are deemed to be accepted by Keith Morris Photography
hereinafter referred to as“the
photographer” and the client (s) specified overleaf they may only be modified
with the written consent of both the photographer and the client (s).
1.Service ProvidedThe photographer will provide
the service required at the time of booking, any variation of the coverage
required is to be discussed with the photographer before the wedding date.
2.DepositsA deposit/retainer fee must be
paid before a booking can be confirmed.
3.Final PaymentsAt least one week before the
wedding a sum equal to 50% of the balance remaining is due and payable, failure
to do so may result in non attendance on the wedding day by the photographer in
which case the full balance remaining becomes due upon demand.The remaining balance becomes due upon
delivery of the completed image file and DVD disks.Payment for additional wedding books/albums
is due when the completed layouts have been approved by the client, before the
order goes for printing.
4.CHANGE OF
WEDDING DATEIn the event of the client(s)
moving the wedding to a different date every effort will be made to accommodate
the revised schedule.If this is not
possible then the cancellation terms in condition 5 will apply.
5.Cancellation by the Client (s)The deposit/retainer is a non
refundable payment.In the event of
cancellation for whatever reason a credit equal to the deposit/retainer will be
given to be used against any future photography requirements of the clients
friends or family.This credit may also
be transferred to any third party of the clients choice.When the deposit/retainer is paid this
provides exclusive rights to the services of the photographer on the booked day
because of this any further work will be declined on that day.A refund of the deposit/retainer may be
possible IF another booking can be taken on the same day in this case a refund
of the deposit/retainer may be made LESS reasonablecosts incurred by the photographer for
arranging the booking, this cost will be no more than 50% of the deposit paid.
6.Accident or IlLness of the photographerIn this
event the required coverage equal to that already booked will be provided by a
third party photographer.The client may
opt for a full refund of all monies paid if this arrangement is not acceptable.
7.COPYRIGHT The copyright of all images
remains with the photographer not withstanding this the client (s) may make as
many copies of image files as required this also includes duplicate disks of
the DVD/Blu Ray slide show.In
consideration of this the client agrees that the photographer may useimages for publicity or advertising
purposesto promote the photographers
business, images will not be used for any financial gain nor passed to any
third party.Should the client (s) not
wish images to be used for this purpose this should be stated clearly on the
booking form.
8.SPECIAL
PHOTOGRAPH REQUESTSAny special group photographs
required should be supplied as a written list at least one week before the
ceremony. No responsibility is accepted by the photographer for incomplete
group coverage by failure to supply the said list.
9.PHOTOGRAPHY
DURING THE MARRIAGE SERVICE Photographs will be taken during the actual ceremony PROVIDED THE
OFFICIATING CLERGY/REGISTRAR ALLOW the photographer cannot be held responsible
if this permission is denied.Many
venues now prohibit photography during the actual marriage vows.
10.Whole Day coverage Where the client (s) has/have booked whole day coverage photography will
begin from where the bride is leaving and end after the first dance at the
reception.If attendance is required
beyond that time the photographer must be advised in advance of the wedding
day, no further charge is made for extended attendance.It is usual for the photographer to be absent
from the reception from the point of sitting down to the meal until the start
of the speeches or cake cutting.
11.Part day coverageWhere the client (s)has/have booked part day coverage photography
will begin with the arrivals at the wedding venue and end with staged cake
cutting photographs BEFORE the start of the reception, speeches will NOT be
photographed.
12.SECURITY OF
CLIENTS FILESAll image files are backed up
and stored in three separate locations, two hard drives and CD/DVD.These files are retained on a permanent
basis, in the event of a client losing or damaging any supplied disks ONE replacement
only will be supplied without charge, further disks will incur a charge of
£10.00 per disk.
13.ONLINE
PREVIEWSPreview files will be uploaded to the
photographers website within 72 hours of the wedding.By default this page will be protected by a
password which will only be disclosed to the bride or groom under no circumstances
whatsoever will the password be disclosed to anyone else. Should the client (s)
not require password protection this must be advised in advance but please
remember the previews will then be in the public domain. These previews must be
regarded as “proofs”, the images will not have undergone any post processing
and do not represent the full quality of the final images supplied. It is
requested that client (s) DO NOT produce prints from these previews the
resolution is NOT sufficient.
14.PHOTOGRAPHY BY
WEDDING GUESTSThe photographer has no desire
to hinder or obstruct guests from taking photographs or video but actively
encourages it but requests that when any formal shots are arranged they wait
until the photographer has finished when he will step aside to allow the guests
unrestricted access
15.Submission of pictures to the pressUnless the
client (s) request otherwise a suitable image will be submitted to the local
press for possible publication.The
photographer cannot guarantee publication which is at the newspaper editors
sole discretion.
